Abstract

The purpose of this document is to expose the legal elements on which the contracting through the modality of the provision of personal services is based, and the effects that can be derived from the observance of the normative assumptions, contained in Article 32 of Law 80 of 1993, and in the Unification Ruling SUJ - 025 - CE - S2 - 2021 of September 9, 2021, issued by the Council of State.

Litigator and consultant in Labor and Social Security Law matters. Assistant Professor, Department of Labor Law. Member of the research group in Labor Law and Social Security Studies. Co-tutor of the research group in Labor Law and Social Security. Former Legal Advisor to the Vice Ministry of Employment and Pensions of the Ministry of Labor. Member of the Colombian Institute of Procedural Law and the Labor Lawyers Association.
